Information concerning the processing of personal data in accordance with Section 13 of Legislative Decree no. 196/2003


Purpose on data processing

The Legislative Decree No. 196 of 30 June 2003 (Italian Data Protection Code) makes provision for the protection of individuals and others with regard to the processing of personal data. HOTELTURIST SPA can fulfil legal and contractual obligation in connection with the provision of hotel services.

Data processing shall be carried out in the manner described in Section 11 of the Legislative Decree: it shall be in the manual form of a computerised paper listing, taking such precautions as are necessary to protect the privacy of the information, and shall be kept for no longer than is necessary to fulfil the legal and contractual purposes for which the data has been collected. Personal data will not be spread out without the approval of the party concerned; they may also be communicated to other hotel and tourist products and services suppliers affiliated to Tivigest trademark in order that they may send information or promotional material (offers, new price lists, advertising material) directly to the client.


The client can decide to communicate his/her data , but the refusal to register them will make it impossible to provide the service.


By filling the form and sending it, the party concerned will agree to the privacy law on the data processing.


To get into particular area of the website or to get access to particular services, it is necessary to supply some personal data, that worked out with other one, could allow the identification of the user.


Anyway, the user is invited not to supply sensitive personal information as set out in Section 4 of Legislative Decree no. 196/2003 especially regarding general health matters without giving his/her consent to the processing of personal data.


Rights of the user to Access Personal Data and Other Rights




A data subject shall have the right to obtain


updating, rectification or, where interested therein, integration and erasure of the data by sending an email to the following address info@tivigest.com or sending a registered letter with return receipt to Hotelturist S.p.a Via Forcellini 150, 35128 Padova, or sending a fax to 049 8033785.


The Data Controller is Hotelturist S.p.a., whose head office is situated at Via Forcellini 150, 35128 Padova, Italy.


All the files, data that build this web site are deposited on the server of the society Omnys S.r.l in Vicenza.


Section 13 of Legislative Decree no. 196/2003


A data subject has the right to be written or verbal informed about:

a) The purpose and the methods of the data processing
b) The compulsory or optional approval of the processing data
c) The result of an eventual non consent of the client to the data processing
d) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as data processor(s) or person(s) in charge of the processing.
e) The rights as per section 7
f) The identification data concerning data controller, data processor and the designated representative(s) in the State’s territory as per Section 5(2)


Cases in which No Consent is required for Processing Data


5) Consent shall not be required if the processing:

a) concerns data taken from documents or records that are publicly available, without prejudice to the limitations and modalities laid down by laws, regulations and Community legislation with regard to their disclosure and publicity;

b) is necessary for carrying out the investigations by defence counsel referred to in Act no. 397 of 07.12.2000, or else to establish or defend a legal claim, provided that the data are processed exclusively for said purposes and for no longer than is necessary therefore by complying with the legislation in force concerning business and industrial secrecy, dissemination of the data being ruled out;

c) is necessary to pursue a legitimate interest of either the data controller or a third party recipient in the cases specified by the Guarantee on the basis of the principles set out under the law.

Section 7
(Right to Access Personal Data and Other Rights)

1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.


2. A data subject shall have the right to be informed


a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.


3. A data subject shall have the right to obtain


a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.


4. A data subject shall have the right to object, in whole or in part,


a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
